By accessing and using samXL Excel automation tools and services, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and others who access or use our software and website.
2. Our Services
samXL provides Excel add-in tools and automation software including bank reconciliation, text transformation, and data analysis tools. We reserve the right to modify or discontinue any part of our services without notice.
3. User Obligations
By using our services, you agree to:
- Use the software only for lawful purposes.
- Not reverse engineer or attempt to extract source code.
- Maintain the confidentiality of your account credentials.
4. Intellectual Property Rights
All software code, architecture, and UI designs are owned by samXLtools Consultancy and protected by international copyright laws. You are granted a limited, non-transferable license for personal or business use.
5. Payment Terms
Methods: M-Pesa (0721 235 356), Bank Transfer, and Card Payments.
6. Refund Policy
We offer a 3-day money-back guarantee if the software does not function as described or technical issues cannot be resolved. Refunds are not issued for changes of mind after 3 days or failure to meet system requirements.
7. Disclaimer of Warranties
Our software is provided "as is" without warranties of any kind regarding accuracy, reliability, or uninterrupted operation.
8. Limitation of Liability
samXLtools Consultancy shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the preceding 12 months.
9. Termination
We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Effects of Termination:
- Access: Your right to use the software and services will cease immediately.
- Data: We are not obligated to maintain any data stored in your account after termination.
- Provisions: All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
11. Changes to Terms
We reserve the right to modify these Terms. Continued use of services after changes constitutes acceptance of the new terms.
